These Terms and Conditions govern your access to and use of all products and services operated by WAGMI Game Co., a Delaware corporation with its principal office at 8924 E Pinnacle Peak Road, STE G5, Scottsdale, AZ 85255 ("Company," "we," "us," or "our"), including NiFe WARS: Last Defense, NiFe WARS digital properties, physical collectibles bearing NFC authentication tags, the Tacara COLLECT platform, and all related content and functionalities (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms, our Privacy Policy, and (where applicable) our End User License Agreement (EULA). If you do not agree, you are prohibited from using the Services.
You must be at least 13 years old to use the Services. If you are under 18, your parent or legal guardian must consent to these Terms on your behalf. Users under 13 are prohibited from using the Services.
To access NFC authentication features and manage your digital collection, you must create a COLLECT account. Registration requires an email address (required) and optionally a phone number for SMS notifications. By creating an account, you consent to data collection as described in our Privacy Policy.
You are solely responsible for maintaining the confidentiality of your account credentials and all activity under your account. Notify us immediately at support@nifewars.com of any unauthorized access. We may suspend or terminate accounts for violations of these Terms or suspected fraud.
You agree to use the Services solely for lawful purposes. You shall not use cheats, bots, or exploits; engage in harassment or abusive behavior; transmit malware; impersonate others; engage in NFC tag spoofing or fraud; or violate applicable laws.
All purchases of physical and digital products are final and non-refundable except where required by applicable law. NFTs are blockchain-based assets you own upon acquisition. Virtual goods are licensed for use within NiFe WARS: Last Defense only and have no monetary value outside it.
Physical products bearing NFC tags use the Tacara platform solely as authenticity verification tools. NFC tags do not track physical location, do not transmit data when not actively scanned, and are linked to a unique digital record accessible through your COLLECT account. See Section 12 for full details.
All content, including code, graphics, virtual goods, NFTs, NFC-linked digital twins, and related materials, is owned by WAGMI Game Co. or its licensors. "WAGMI Game Co.," "NiFe WARS," "Tacara," and "COLLECT" are trademarks of WAGMI Game Co. and may not be used without written permission.
The Services are provided "as is" and "as available," without warranties of any kind. We disclaim any guarantee regarding the value, performance, or availability of NFTs, blockchain integrations, physical collectibles, NFC tag functionality, or the Tacara COLLECT platform.
To the maximum extent permitted by law, WAGMI Game Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or NFT value, arising from your use of the Services.
NFC tags are authenticity verification tools only — not tracking devices. Accordingly:
These Terms are governed by Delaware law. Disputes shall be resolved by binding arbitration under AAA Commercial Rules in Wilmington, Delaware. Class actions are waived. You may opt out within 30 days by emailing support@nifewars.com.
Tacara (tacara.io) is an NFC authentication, digital twin, and collector account platform operated by WAGMI Game Co. Your COLLECT account allows you to scan, register, and manage NFC-tagged NiFe WARS collectibles and access their associated digital records.
Each NFC-tagged collectible contains a unique, tamper-evident chip. When scanned, the chip transmits a unique identifier to verify the item's authenticity. If authenticated, your COLLECT account associates that item with your registered collection (your "digital twin" record). The scan confirms only that the physical item is a genuine NiFe WARS product — nothing more.
WAGMI Game Co. expressly disclaims all liability for the loss, theft, destruction, or unauthorized transfer of any NFC-tagged physical collectible. NFC registration is not insurance. If your tagged item is lost or stolen, contact local authorities. We cannot assist in recovery efforts, as we have no real-time knowledge of item location or possession.
If you close your COLLECT account, your digital twin records will be disassociated from your profile. The physical NFC tag will remain functional for authenticity scanning but will no longer be linked to a registered collector account unless re-registered by a subsequent owner.
When you opt in to receive SMS messages from WAGMI Game Co., we use your mobile phone number solely for first-party communications related to your account and NiFe WARS products. We do not sell or share your phone number. Reply STOP to opt out at any time. Message and data rates may apply.
